He would probably do well to contact David Merrill. The applying for permits is at the heart of the problem. Likely "water" in Oregon statutes means water on public land. If his land is private then his water would not likely be comprehended by the statute. But application for the license presupposes public nature of his land and the reservoirs.

If it is the cities water what is the city doing about it to keep it off my property?

Yep counterclaims can be powerful. HARRINGTON (public side legal person) doesn't seem to know.
