View Full Version : Hello everyone! I'm happy to be here, but time is short. Please Help!

I have a felony warrant in one state (6 or 7 years old). I moved to a neighboring state thinking I'd be safe. Nope. Not safe. It's an extradition warrant and it's assigned to the city in which I work.

The charge is Felony Evidence Tampering. I did not harm anyone or their property. It was a case of mistaken identity on the part of an off-duty police officer and he gave me this charge to cover his own ass.

I've spoken with several lawyers about this thing and they all agree that the charges are baseless and the case is a slam dunk. I have my own evidence that refutes the officers charge of evidence tampering. They also all agree that I will have to turn myself in and do 'some' time in jail while awaiting trial (no bond warrant). This is unnacceptable to me as I have a family to support and a great job that I don't want to lose.

I was told that the first thing to do would be to remove myself from their jurisdiction via affidavit. Not exactly sure what that means or how to go about doing it.

I wish I had gotten on to this years ago, but I didn't. I realize I will need to educate myself and I am a quick study, but without help.....I'm lost in a wilderness of legal terms.

Please Help! I'll pay it forward at the very least.

I'm actually fairly well-versed in lawful money and have several 'test cases' developing for around 4 months. Will be next year before they can file for the first time as a full year of demand is needed.

What I need is to handle my case administratively rather than the old-fashioned way of me being locked in a cage for months on end only to prove my innocence in court whenever they get around to having a trial.

Then you might want to read about setting up a court of record. A place for filing affidavits etc.

I suggest you process a Libel of Review. The papers you have expressing a warrant would be refused for cause and it sounds like you would name the officer who never corrected the misnomer. Get this processed and you have the facts in federal court and everybody knows the facts are in federal court. It sounds like the inevitable is that you will either be arrested or turn yourself in. Have the facts handy and any judge ignoring them will be injuring you unnecessarily. Do whatever judge handles this a big favor, have the facts, including your evidence you speak of right there on PACER for him to see. Maybe you will only spend a couple hours in booking?

I completely agree with David Merrill. Looked into it. That would be a ballsy move. I'm not opposed to it, if it is the proper solution. I wouldn't want to stir up the hornet's nest though if it wouldn't bring any real results though, you know?
