FOIA Requirements

Hi all,

Recently, I submitted a FOIA request for my IMF, NMF, BMF, and other records. Has anyone done the same?

I just received a letter back from a Disclosure Specialist. They're claiming I need to
- Properly establish my identity (it was notarized, but it was on a separate page from my closing signature. However, it still had my signature in the "Subscribed and Affirmed" statement that I've seen others use here)
- Provide my 'valid EIN authority' (I requested my BMF for the EIN-formatted version of my SS Number (via SEDM)).
- State my agreement to pay (which I did. Kind of confused on that one)

They also claim that:
- The FOIA doesn't require the IRS to certify documents, but will send a certified copy of my returns if I use Form 4506.
- I can get other information returns (W2, 1099's, etc) via a 4506-T. I'm guessing this has nothing to do with my actual backing transcripts.

They highlighted the use of a driver's license to establish identity, but I'm reluctant to do this given other topics here. Similarly, I could make some 'penalty of perjury' statement, but wouldn't that create some sort of status assumption? Maybe it doesn't matter in this context, but I'd rather not do more harm than good.

My question (which I realize isn't clear) is whether this person's just trying to stall, or if I'm truly doing something wrong. I'm mostly asking if anyone else has successfully received their official internal transcripts, including their BMF?

First question -- are the records you are trying to obtain for "Sabo" or "SABO"? I suspect "they" only have records for the latter, their legal fictions. FOIA is only for "YOUR" records, so they may rightfully demand you produce identification for SABO (via presumptions created by a DRIVER LICENSE, etc.) prior to releasing the records.

The converse to the FOIA is the "Privacy Act" request, which are for records related to someone/something other than you. If it were me, I'd craft my letter as a FOIA or Privacy Act request (let them figure it out), then send a notarized identity document I created (with multiple witnesses attesting to my identity) identifying myself on my terms. If they respond "That's not you" or "We have no documents on you" I would respond, thank you very much!

In this case, I still need to see what things they believe they know about me.

I've heard plenty of stories about the IRS alleging ATF connections, keeping BMF (Business) records on people who are not business entities, etc. They started doing an illegal levy on my pay recently (which I've written to the Technical Advisory Group to try to quash, since 6331(A) clearly states the limited nature of its application), and I feel it would be helpful to try to see and potentially clear any other assumptions they have.

Saying they don't have any records on my self-identification isn't going to help me in this case (as far as I can tell).
