How can I patent a mining claim? (considering the BLM moratorium on processing them)

Just a thought. There's 1 or 2 places in upstate California that I would like to patent, on forestry land. But the BLM has refused to budget money for the processing of mining claim patents since like 1994.

Any ideas?

when I have time, i'll sit down with a professor from my old school who is a property law/rights lawyer. If I get any insights from him, i'll share it with the group
